New tax provisions in 2023 for property owners

The administration updates its online service for landowners to facilitate their online declarations now mandatory for all.

Since January 2023, the 2020 Finance Law requires each owner to inform the French tax authorities who lives in his or her property.

This declaration concerns all owners of real estate in France for residential use, individuals and companies.

At the national level, this new declaration concerns 34 million owners for 73 million premises.

What about the housing tax?

As a reminder, the taxe d'habitation is a local tax that is levied on housing occupied as a principal residence. It is intended to finance local expenses such as public services, schools and infrastructure.

In 2023, this tax will be abolished for all primary residences. The other types of housing remain subject to the housing tax, i.e. secondary residences and vacant premises.

In order to identify the premises still subject to the tax, a new reporting obligation has been introduced for owners, whether they are natural or legal persons.

The objective of the French administration is to be able to identify precisely which owners might still be liable for the tax on second homes or the tax on vacant dwellings.

Owners will have to indicate the nature of the occupation of each premises and, when they do not occupy them themselves, the names of the occupants and the period of occupation (as of January 1, 2023).

How to proceed?

Owners have until June 30, 2023 to report this information. Thereafter, only changes in status will require a new declaration.

It must be done directly on the website in the section"Manage my real estate". The data known to the tax authorities will be pre-filled to facilitate the process.
